These Terms and Conditions (“Terms”) govern your use of luckybydesignagency.com and any services provided by Lucky By Design Agency. By using our website or engaging our services, you agree to these Terms in full.

Lucky By Design Agency (“LBD,” “we,” “us,” or “our”) provides brand strategy, identity design, and web design services to clients (“you,” “Client”). These Terms apply to website visitors and to clients who engage our services, unless a separate client service agreement is in place (in which case that agreement governs the engagement).

2. Website Use

You may use our website for lawful purposes only. You agree not to:

Use the site in any way that violates applicable laws or regulations
Attempt to gain unauthorized access to any part of the website or its infrastructure
Transmit any unsolicited commercial communications or malicious code
Reproduce, duplicate, copy, or resell any portion of the site’s content without our express written permission

We reserve the right to restrict access to the website at any time without notice.

3. Services

LBD offers a range of brand strategy, identity design, and web solutions. Our core service framework is The Lucky Break System™, a three-phase methodology encompassing brand positioning and messaging (Focus), visual brand identity (Identity), and execution across channels (Recognition). Specific services include:

Full-Service Engagements:

Brand strategy and positioning
Brand identity design (logo, visual system, style guide)
Website design and development
Full Lucky Break System™ engagements combining strategy, identity, and web

Audit & Advisory Services:

Website audits — a focused review of your existing website delivering a prioritized action plan to improve clarity, conversion, and brand consistency

Productized Services:

Canva Takeover – Custom-built Canva templates designed to your brand, enabling clients to create on-brand content independently ($999)
Quarterly Brand Sync – An ongoing brand advisory retainer providing strategic check-ins, brand consistency reviews, and guidance each quarter ($555/quarter)

Specific deliverables, timelines, and pricing for any engagement are outlined in a separate proposal, contract, or Statement of Work (“SOW”) provided to the client prior to project commencement. Productized service terms (including refund eligibility and delivery timelines) are specified at the point of purchase.

These Terms supplement — and do not replace — any signed client agreement. In the event of a conflict between these Terms and a signed agreement, the signed agreement controls.

4. Intellectual Property

Our website content: All content on luckybydesignagency.com — including text, graphics, logos, images, and the LBD brand identity — is the property of Lucky By Design Agency and protected by applicable copyright and trademark laws. You may not reproduce or distribute our content without prior written consent.

Client work: Ownership of deliverables created for clients is governed by the terms of the applicable client agreement. Generally, full ownership of final deliverables transfers to the client upon receipt of final payment. LBD retains the right to display completed work in our portfolio unless otherwise agreed in writing.

Third-party assets: Certain design assets (fonts, stock imagery, templates) may be subject to third-party licensing terms. We will advise clients of any relevant licensing restrictions that apply to their deliverables.

5. Payment

Pricing, payment schedules, and refund policies for specific services are outlined in individual proposals or client agreements. General terms:

Projects do not begin until a signed agreement and any required deposit are received
Final deliverables are not released until full payment is received
Overdue invoices may be subject to a late fee of 1.5% per month or the maximum permitted by law, whichever is less
LBD is not responsible for project delays caused by late client feedback, approvals, or payments

6. Client Responsibilities

Clients agree to:

Provide accurate, complete, and timely information required for project completion
Review and approve (or provide feedback on) deliverables within agreed timeframes
Ensure they have the rights to any assets, content, or materials provided to LBD for use in the project
Pay all invoices according to the agreed schedule

Failure to meet these responsibilities may result in project delays, additional fees, or project termination at LBD’s discretion.

7. Limitation of Liability

To the fullest extent permitted by law, Lucky By Design Agency shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website or our services — including, but not limited to, loss of revenue, loss of data, or business interruption.

Our total liability for any claim arising out of or related to our services shall not exceed the total fees paid by the client for the specific project giving rise to the claim.

8. Disclaimer of Warranties

Our website and its content are provided “as is” without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted, error-free, or free of viruses or other harmful components.

Results achieved through our branding and design services will vary depending on many factors outside our control, including but not limited to client implementation, market conditions, and business operations. We make no guarantees of specific business outcomes.

9. Third-Party Links

Our website may contain links to third-party websites. These links are provided for convenience only. LBD has no control over the content or practices of third-party sites and accepts no responsibility for them. Visiting linked sites is at your own risk.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

We reserve the right to modify these Terms at any time. Changes take effect when posted to this page with a revised “Last Updated” date. Your continued use of our website after changes are posted constitutes acceptance of the updated Terms.
